By means of this resolution is to convene the granting by the Spanish Office of patents and trademarks (OEPM) of subsidies for the promotion of applications for patents and utility models by the year 2015, within the framework of the IET9402013 order of 24 may, which establishes the regulatory bases of these subsidies.
This event consists of two programs:
(a) programme of aid for the promotion of applications for patents and utility models abroad:
Aimed to stimulate the international protection of technology through patents or utility models. The objective is to improve the competitiveness of the companies that undertake the search for markets outside Spain, especially small and medium-sized enterprises (SMEs) and individuals.
To do this, to help overcome the main barriers that the applicant can be found on the achievement of a European patent, international or a national patent in foreign national offices these grants focus on subsidizing activities that presuppose costs by payment of fee in the respective countries on the basis of a few amounts of reference set out in the present call for each type of activity carried out in a country or group of countriesas well as subsidizing the completion of the translation into the language of the country in which extension is performed.
(b) programme of aid for the promotion of applications for patents and utility models Spanish SMEs and individuals:
Aimed at stimulating the national protection of technology through patents or utility models in order to improve the competitiveness of small and medium-sized enterprises and individuals, such aid focus on subsidizing requests for patents and Spanish utility models that involve the payment of a fee.
Development of applications for patents and utility models abroad
Concepts of subsidies.
1. Aid shall be granted, where appropriate, by performing any of the following activities, which will be compatible among themselves:
(a) the extension of an application for a patent or of a utility model in accordance with the provisions of article 18 of the present call, to nationals of third countries offices or regional patent offices, in the framework of granting of patents or utility models national or regional procedures.
The following procedures will be eligible:
- The application of a patent or of a utility model.
- The validation of a European patent.
- Searches on the State of the technique.
- The examination of the patent application.
- The grant of the patent.
- Designation of countries, the number of claims excess and annuities before the European Patent Office (EPO).
- The translation of the complete reports of applications for patents or utility with object models present the same to the nationals of third countries offices or regional patent offices.
(b) the activities carried out within the international procedure PCT, in accordance with the provisions of article 18 of the present call.
The following procedures will be eligible:
- The international application PCT when the SPTO has acted as receiving Office.
- Search international (IBI) when the SPTO has acted as international search administration.
- International preliminary examination when the SPTO has acted as international preliminary examination administration.
Development of applications for patents and utility Spanish models
Concepts of subsidies.
1. May be subsidized in the accomplishment of any of the following activities:
- The request for a Spanish utility model.
- The request and conducting the search report searches on the State of the technique (EIT) for Spanish patent applications.
- A patent application Spanish priority of an international application PCT whose report of international search (IBI) is completed prior to the report on the State of technology (EIT).
2. Eligible activities shall be carried out when the utility model or patent application together with the report on the State of the technique in the «Official Gazette of the property industry» of the OEPM, been published provided that they involve the payment of a fee.
3. The subject of grant activities are those applications of patent or utility model which have been published, in the case of the patent application, the IET or the mention of IBI, during the years 2013, 2014 and 2015 until the date of expiry of the deadline for submission of applications of this call, provided that they have not received grant in the previous calls for these aid.
